Ultimate user of benefits, inscription into the Business Register

We have the honour to inform you that effectively since 1st November 2018, an obligation to in-script ultimate users of benefits into the Business Register has arisen for all trade companies. The existing companies are thus obliged, until 31st December at the latest, to issue a proposal for inscription of data about the ultimate user of benefits.

Companies are obliged to register the data in question also in their internal directives. The data have to be always up-to-date, thus respond to the actual state and have to be archived at least for 5 years.

In case of breach, or violation of the obligation stated in this Act, the Financial Intelligence Unit can impose a fine on the physical or legal person, or entrepreneur, up till the sum of € 200 000.

By nonobservance of the deadline on the inscription of ultimate user of benefits, or by inadequate presentation of data, the company could be damaged by a sanction up to € 3 310.
